  1. Each entrant agrees and acknowledges that they have read these Conditions of Entry and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry. Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.
  2. The Promotion commences on the Start Date and ends on the End Date. Where applicable, entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
  3. Valid and eligible entries will be accepted during the Promotional Period. The Promoter accepts no responsibility for any entry that is delayed, lost or not received due to circumstances beyond the Promoter’s reasonable control.
  4. Officers and employees (and their immediate family members) of the agencies/companies directly associated with the conduct of this Promotion, the Promoter, businesses involved in determination of winner/s for the Promotion, businesses involved in the management of the Promotion, any organisation benefiting from the Promotion, the Promoter’s distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter.
  5. Entrants under 18 years of age must have the consent of a parent or legal guardian (over 18 years of age) to enter the Promotion. The parent or legal guardian must read and consent to these Conditions of Entry. An entry submitted without the required consent will be invalid.
  6. If a Prize winner is under 18 years of age, the Prize will be delivered to the winner’s parent or legal guardian on the winner’s behalf. The Promoter may require evidence of the parent or legal guardian’s identity and authority before delivering the Prize.
  7. All reasonable attempts will be made to contact each winner.
  8. If any winner of Prizes 1 to 4 chooses not to take their Prize (or is unable to take it), or does not claim a Prize within the time specified in these Conditions of Entry, the winner will forfeit the Prize and the Promoter is not obliged to offer a substitute Prize. Prizes 5 to 154 do not need to be claimed and will be applied automatically in accordance with the Schedule.
  9. Prizes are as stated and are not exchangeable, transferable or redeemable for cash, nor will any alternative prize be offered, unless otherwise specified in writing by the Promoter.
  10. If a Prize (or portion of a Prize) is unavailable, the Promoter reserves the right to substitute the Prize (or that portion of the Prize) to a prize of equal or greater value and specification, subject to any written directions of a regulatory authority.
  11. No fee is charged by the Promoter to enter the Promotion. Where entry is allowed online, there is no additional cost to enter the Promotion other than any cost paid by the entrant to access the website or social media platform of entry via their Internet service provider.
  12.   Use of The Shed
    1. The Shed rewards platform is available at https://imartheshed.com.au/ (Rewards Platform) and is provided by the Promoter to eligible users. The Rewards Platform is operated on the Promoter’s behalf by Wink. Wink is not a Gallagher group company.
    2. Use of the Rewards Platform, membership of The Shed, and the earning, holding, redemption and forfeiture of cashback rewards (including each Credit Prize) are governed by the Rewards Terms, and not by these Conditions of Entry.
    3. By registering for, or continuing to use, the Rewards Platform, each entrant agrees to be bound by the Rewards Terms and acknowledges that they have read and understood them, including the provisions dealing with:
      1. eligibility for, and suspension or termination of, membership of The Shed;
      2. the collection and use of personal information by the Promoter and Wink;
      3. the disclosure of personal information by the Promoter to Wink, by Wink to the Promoter, and to third parties;
      4. the reversal and forfeiture of cashback rewards, and the minimum balance and activation requirements that apply before cashback rewards may be redeemed; and
      5. the limitations and exclusions of liability, and the indemnity, in favour of the Promoter and Wink.
    4. To the extent of any inconsistency between these Conditions of Entry and the Rewards Terms in relation to the Rewards Platform, membership or cashback rewards (including a Credit Prize ), the Rewards Terms prevail. These Conditions of Entry govern the conduct of the Promotion and the award of Prizes.
    5. Nothing in this clause 12 limits, excludes or modifies any Non-Excludable Guarantee (defined below).
    6. The Rewards Terms may be updated from time to time at the Promoter’s discretion by providing notice on the Promoter’s website of the changes.  If an entrant does not agree to be bound by any changes to the Rewards Terms then they must cease to use and access the Rewards Platform.
  13. The Promoter collects personal information from all entrants in order to conduct the Promotion and may, for this purpose, collect, use and disclose such information to third parties, including but not limited to agents, contractors, service providers, Wink, Prize suppliers and as required, to regulatory authorities. The Promoter may also collect and use the personal information from entrants for the purpose of sending entrants marketing and promotional communications regarding the Promoter’s goods and services. Please see the Promoter’s Privacy Policy (see below) for more information about how the Promoter collects, stores, uses and discloses personal information, including details about overseas disclosure, access, correction, how entrants can make a privacy-related complaint and the Promoter’s complaint-handling process. By providing personal information to the Promoter, the entrant agrees to the collection, use, storage and disclosure of that information as described in this clause 13 and the Promoter’s Privacy Policy found at https://www.ajg.com/au/global-privacy-notice/.
  14. The Promoter’s direct marketing communications will, where required by the Spam Act 2003 (Cth), contain a functional unsubscribe functionality that the entrant may use to opt-out of any further such communications and provided that the functional unsubscribe facility complies with the Spam Regulations 2021 (Cth).
  15. For the purposes of public statements and advertisements, in respect of Prizes 1 to 4, the Promoter may only publish the winner’s surname, initial and, for winners located in South Australia, their postcode of residence. Winners of Prizes 5 to 154 will not be publicly announced.
  16. If a Prize is provided to the Promoter by a third party, the Prize is subject to the terms and conditions of the third party prize supplier which each winner accepts by virtue of claiming their respective Prize. The terms and conditions which apply to the Prize at the time it is issued to the winner will prevail over these Conditions of Entry in the event of any inconsistency. To the extent permitted by law, the Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the Prize, any delay or failure relating to the Prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.
  17. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify any legislation which cannot lawfully be excluded or limited, including the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or any other applicable State or Territory legislation (“Non-Excludable Guarantees”).
  18. Each winner expressly acknowledges that despite anything to the contrary but subject to the Non-Excludable Guarantees, the Promoter (and its associated agencies and companies) will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained in connection with this Promotion or the Prize.
  19. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may, in its sole discretion, withdraw, cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a Prize, subject to State or Territory regulation and the entrants or winner will not be entitled to any compensation.
  20. Except as set out in clause 6 above, each Prize will be awarded to the person named in the entry and any entry that is made on behalf of an entrant or by a third party will be invalid. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant’s details (including an entrant’s identity, age and place of residence). If a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the Prize in whole and no substitute Prize will be offered to that winner. The Prize may be awarded to a reserve entrant or replacement winner in accordance with the Schedule. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will (at the Promoter’s discretion) be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
  21. Each entry must be made by, and each Prize will be awarded to, a natural person. Where the holder of an Eligible Policy is a company, trust, partnership or other entity, the entrant is the individual nominated by that entity as the sole authorised user of its The Shed account in accordance with the Rewards Terms.
  22. A maximum of one (1) entry only will be accepted in respect of each The Shed account and a maximum of one (1) Prize may be awarded to each entrant and in respect of each The Shed account. The Promoter may require an entrant to provide evidence that they are the nominated individual, and may declare an entry invalid if that evidence is not provided. An entrant under 18 years of age may be a nominated individual if permitted under the Rewards Terms.
  23. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Conditions of Entry. If there is a dispute concerning the conduct of the Promotion or claiming a Prize, the Promoter will resolve the dispute in direct consultation with the entrant. If the dispute cannot be resolved the Promoter’s decision, acting reasonably, will be final.
  24. Entrants are responsible for ensuring that their contact details are complete, accurate and current. The Promoter is not responsible where it is unable to contact a winner because the contact details available to it are incorrect, incomplete or no longer current.
  25. The Promoter may communicate, advertise or run this Promotion using Facebook or Instagram. However, the Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. You provide your information to the Promoter and not to Facebook or Instagram.
  26. By entering the Promotion, an entrant releases and indemnifies the Promoter, Facebook and Instagram (including its officers, employees and agents) from and against all actions, liabilities, penalties, claims or demands the entrant may have against the Promoter, Facebook or Instagram or that the Promoter, Facebook or Instagram may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an entrant entering or participating in the Promotion or winning or failing to win a Prize, or using or permitting any other person to use the Prize, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable.
  27. Notwithstanding any other clause in these Conditions of Entry, the Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation). For the sake of clarity, this clause shall not apply where the Promoter has contributed to or caused such loss, expense, damage, personal injury or death and shall not apply to any liability which cannot be excluded by law (in each case the Promoter’s liability is limited to the minimum allowable by law).
  28. The Promoter accepts no responsibility for any tax implications relating to receipt of a Prize and the entrant must seek their own independent financial advice in regards to the tax implications relating to receipt of a Prize.
  29. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
  30. Authorised under: ACT Permit No. TP 26/02614
  31. These Conditions of Entry are governed by the laws of New South Wales. Entrants submit to the jurisdiction of the courts of New South Wales.
